4. Additional terms

The following documents form part of the DreamCode legal framework:

  • DreamCode Interactive Privacy Policy;
  • DreamCode Interactive Terms of Service;
  • DreamCode Cookie Policy;
  • DreamCode Hub Terms and Conditions;
  • DreamCode Cloud Terms and Conditions;
  • DreamCode OS Terms and Licence;
  • DreamCode Refund Policy.

Where a service-specific document contains rules specifically addressing that service, those rules apply to that service.

5. Accounts

Certain DreamCode services require an account.

You agree to provide accurate information when creating an account.

You are responsible for:

  • protecting your login credentials;
  • keeping your account secure;
  • keeping your email address current;
  • notifying us if you believe your account has been compromised.

You must not knowingly share your account credentials in a manner that allows unauthorised persons to access your account.

6. Account ownership

Your account is personal to you unless DreamCode expressly permits otherwise.

You may not sell, transfer or commercially exploit your DreamCode account without our permission.

7. Account security

We may implement security measures including:

  • authentication requirements;
  • email verification;
  • session expiration;
  • login restrictions;
  • device restrictions;
  • security checks;
  • anti-abuse systems.

These measures may change over time.

8. Games

DreamCode develops and publishes games and may also make third-party games available through its services.

A game may be:

  • sold through DreamCode Hub;
  • made available through DreamCode Cloud;
  • distributed through another platform;
  • offered temporarily;
  • offered for free;
  • removed from a service.

Availability may differ between services.

9. Digital licences

Unless expressly stated otherwise, purchasing a digital game does not transfer ownership of the game's intellectual property.

You receive a limited licence or access right to use the game in accordance with the applicable game licence and service terms.

You may not represent yourself as the owner of DreamCode's intellectual property merely because you purchased a game.

10. Intellectual property

DreamCode and its licensors retain intellectual-property rights in:

  • games;
  • software;
  • source code;
  • compiled code;
  • artwork;
  • graphics;
  • music;
  • sound effects;
  • videos;
  • trademarks;
  • logos;
  • websites;
  • interfaces;
  • designs;
  • documentation;
  • written content.

Nothing in these Terms transfers those rights to you.

11. Purchases

DreamCode Hub may allow you to purchase digital products.

Payments are processed using Paddle.

Paddle may act as Merchant of Record for applicable purchases.

The purchase process may include additional terms provided by Paddle.

12. Pricing

Prices displayed on DreamCode Hub are subject to change.

Where required by applicable law, the price presented to you at checkout will contain the applicable charges, taxes or other amounts required to be disclosed.

A price change does not retroactively change the price of an already completed purchase.

13. Refunds

Refunds are governed by the DreamCode Refund Policy and applicable consumer law.

DreamCode may voluntarily offer a ten-minute refund window for eligible purchases.

That voluntary policy does not limit mandatory statutory rights.

14. Digital-content withdrawal rights

Where applicable law gives you a statutory withdrawal right, that right will be respected.

For digital content supplied immediately, the applicable EU rules allow the withdrawal exception where the consumer has provided the required prior express consent to begin performance, acknowledged the resulting loss of the withdrawal right, and the required confirmation has been provided. (EUR-Lex)

DreamCode will implement the applicable consent and acknowledgement requirements at checkout.

15. DreamCode Cloud

DreamCode Cloud is governed by the DreamCode Cloud Terms and Conditions.

Cloud availability is not guaranteed for every game.

Purchasing a game does not automatically guarantee cloud availability.

16. DreamCode OS

DreamCode OS is governed by the DreamCode OS Terms and Licence.

17. Acceptable use

You may not use DreamCode services to:

  • commit unlawful activity;
  • distribute malware;
  • attack our infrastructure;
  • interfere with another user's access;
  • attempt to gain unauthorised access;
  • circumvent authentication;
  • circumvent technical protections;
  • abuse cloud-gaming resources;
  • manipulate transactions;
  • commit refund or chargeback fraud;
  • distribute unauthorised copies of games;
  • infringe intellectual-property rights;
  • use automated systems to abuse our services;
  • intentionally disrupt service availability.

18. Security research

Nothing in these Terms is intended to prohibit lawful security research.

However, security testing must not:

  • intentionally disrupt production services;
  • access another user's data;
  • destroy data;
  • obtain payment information;
  • deploy malware;
  • conduct denial-of-service attacks.

Security vulnerabilities should be reported to:

hello@dreamcode-interactive.site

19. Service availability

DreamCode does not guarantee that its services will always be available.

Services may be unavailable due to:

  • maintenance;
  • updates;
  • security incidents;
  • infrastructure failures;
  • network failures;
  • third-party provider failures;
  • game-specific problems;
  • attacks;
  • legal requirements;
  • circumstances beyond our reasonable control.

20. Changes to services

We may:

  • add features;
  • remove features;
  • modify interfaces;
  • change technical requirements;
  • update software;
  • change supported devices;
  • change supported games;
  • modify cloud capacity;
  • discontinue individual services.

Where applicable law gives you rights because of a significant change, those rights remain unaffected.

21. Temporary suspension

We may temporarily suspend a service when reasonably necessary to:

  • perform maintenance;
  • investigate security incidents;
  • prevent abuse;
  • protect infrastructure;
  • respond to attacks;
  • comply with law.

22. Permanent discontinuation

DreamCode may discontinue a game, feature or service.

We do not promise that a particular service will operate indefinitely.

Nothing in this section removes mandatory consumer rights or remedies.

23. Account suspension and termination

We may suspend or terminate an account where reasonably necessary because of:

  • serious violation of these Terms;
  • fraud;
  • abuse;
  • unlawful activity;
  • attacks against our infrastructure;
  • unauthorised access;
  • payment abuse;
  • repeated circumvention of restrictions.

Where appropriate, we may provide notice or an opportunity to remedy a violation.

24. Consequences of termination

If an account is terminated, you may lose access to services associated with that account.

Termination does not automatically cancel rights that cannot legally be terminated.

25. Third-party services

DreamCode may rely on third-party services and infrastructure.

These services may have their own privacy policies and terms.

Examples include infrastructure and payment providers.

DreamCode is not responsible for the independent operation of third-party services.

26. Disclaimers

To the maximum extent permitted by law, DreamCode does not guarantee that every service will:

  • be uninterrupted;
  • be error-free;
  • work on every device;
  • meet every individual expectation;
  • remain available indefinitely.

Mandatory statutory rights and legal guarantees are not excluded.

27. Limitation of liability

To the maximum extent permitted by applicable law, DreamCode will not be liable for indirect or unforeseeable losses resulting from use of the services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

28. Consumer rights

If you are a consumer, you retain any mandatory rights granted to you by the laws applicable to your consumer contract.

Nothing in these Terms is intended to deprive you of those rights.

EU digital-content rules provide statutory remedies where digital content or digital services fail to conform to the contract, including circumstances in which consumers may be entitled to correction, price reduction or termination. (EUR-Lex)

29. Changes to these Terms

We may update these Terms from time to time.

When changes are material, we will provide notice where required.

Your continued use of a service after the effective date of updated Terms may constitute acceptance where permitted by applicable law.

30. Governing law

These Terms are intended to be governed by Romanian law, subject to mandatory consumer-protection laws applicable in the country where you reside.

31. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

32. Entire agreement

These Terms and the documents incorporated into them form the agreement governing your use of the relevant DreamCode services, subject to mandatory rights and applicable law.
